These Terms govern your use of the websites and services of CareBoss, Inc.("CareBoss," "we," "us"). By using our services, you agree to these Terms.
1. What CareBoss is — and isn't
CareBoss is a marketing and technology company. We help families find home care by connecting them with independent, licensed home care agencies, and we provide software and marketing services to those agencies. CareBoss is not a home care agency, healthcare provider, or staffing agency, and we do not provide care or medical advice. All care is delivered by independent agencies who are solely responsible for their services, staff, licensing, and compliance.
2. Eligibility & accounts
You must be 18+ to use our services. If you create an account, you're responsible for keeping your credentials secure and for activity under your account, and for providing accurate information.
3. For families seeking care
When you submit a request, we share your details with one or more partner agencies who may contact you. Any agreement for care is strictly between you and the agency. We don't guarantee the availability, quality, pricing, or outcome of any agency's services, and we're not a party to your arrangement with them. Always verify an agency's licensing and suitability for your needs.
4. For agency partners
If you subscribe as an agency, we provide marketing, lead-generation, and software services for a recurring fee as described at signup or in your agreement. You are responsible for your own licensing, bonding, insurance, staffing, and for independently deciding whether to accept any referral and for all care you deliver. Our fees are for marketing and technology services and are not contingent on the volume or value of any referrals.
5. Payment
Paid subscriptions are billed in advance on a recurring basis through our payment processor. Unless stated otherwise, fees are non-refundable except as required by law or by any written guarantee we provide. You can cancel as described in your agreement.
6. Acceptable use
Don't misuse the services: no unlawful, infringing, or harmful activity; no scraping or unauthorized access; no false information; and no use that violates applicable home-care, privacy, or marketing laws.
7. Disclaimers
The services are provided "as is" without warranties of any kind. We do not warrant that the services will be uninterrupted or error-free, or that any referral will result in a placement, client, or revenue.
8. Limitation of liability
To the fullest extent permitted by law, CareBoss will not be liable for any indirect, incidental, or consequential damages, or for the acts, omissions, or care provided by any agency. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
9. Indemnification
You agree to indemnify CareBoss against claims arising from your use of the services, your violation of these Terms, or, for agencies, the care you provide.
10. Governing law & changes
These Terms are governed by the laws of the State of California. We may update these Terms; continued use after changes means you accept them.
